District Judge Yvonne Gonzalez Rogers in Oakland California ruled Friday that the plans exclusion of a form of therapy called applied behavior analysis ABA violated the Mental Health.

The plan may not limit the number of visits an individual may. The exclusion of ABA specifically in relation to the treatment of autism violates MHPAEA. ABA is considered a covered autism treatment.

Exclusion creates a separate treatment limitation applicable only to services for a mental health condition Autism Rogers wrote in her ruling. Applied Behavior Analysis ABA is a type of therapy that focuses on improving specific behaviors such as social skills communication reading and academics as well as adaptive learning skills. Behavior analysis has since expanded from controlled laboratories into applied settings including hospitals clinics schools family homes and communities.

If a plan covers physical treatments that plan must cover mental health services too. ABA is considered a covered autism treatment. The spread of the Coronavirus COVID-19 has caused ABA organizations to become increasingly concerned about the future of their business and the services they provide.

ABA therapy includes many different techniques. Evidence based means that ABA has passed scientific tests of its usefulness quality and effectiveness. Under the plans definition ABA therapy is not experimental but the plan denied all claims for ABA therapy to treat children with ASD under the rationale that the treatment is experimental.
